In the context of a fight, simple assault is considered a third-degree misdemeanor, which can lead to a maximum one-year jail term and a fine of no more than $2,500.
Aggravated Assault
Aggravated assault is a more serious offense and can encompass knowingly or recklessly inflicting serious bodily injury, using a deadly weapon, or assaulting public officials such as police officers, firefighters, judges, and more. Serious bodily injury is defined as significant impairment, permanent loss of organ function, disfigurement, or an injury that poses a significant risk of death.
First offense aggravated assault in Texas is classified as a first-degree felony, carrying a maximum prison sentence of 20 years and a fine not exceeding $25,000. Aggravated assault cases without serious injury are categorized as second-degree felonies, with potential penalties of up to 10 years in prison and a maximum fine of $25,000.
